In Mexican labor law, the principle of stability in employment governs. As a general rule, employment relationships are understood to be for an indefinite period. The Federal Labor Law expressly establishes in its Articles 35, 36, and 37 that a fixed-term (temporary) contract or a contract for a specific project can only be entered into when the nature of the service to be provided requires it or when its purpose is to temporarily replace another worker.
The risk of simulating temporality
An extremely costly mistake that many companies make is hiring personnel for permanent operational tasks using temporary contracts that are renewable every month or every three months. In litigation, if the company cannot provide documentary proof of the objective cause that justified the temporary nature of the contract, the court will consider that the employment relationship was always for an indefinite period.
Consequently, termination or the simple "non-renewal" of the contract at the end of its term will be classified as an unjustified dismissal, forcing the company to pay constitutional severance, 20 days of salary per year worked, and back wages.
